This Acceptable Use Policy ("AUP") describes prohibited uses of the Lyberty Services. It is incorporated into the Terms of Service and applies to every Customer, user, agent, contractor, employee, and end user accessing the Services (collectively, "you"). Capitalized terms not defined here have the meanings in the Terms.
Lyberty may update this AUP from time to time. Continued use of the Services after the effective date constitutes acceptance.
Why this exists
The Services touch sensitive business data, AI models, marketing channels, third-party platforms, and operational automations. Misuse can harm individuals, customers, third parties, regulated industries, and the integrity of the Services. This AUP sets the line between legitimate use and use that creates legal, security, regulatory, or platform risk.
You will not
Illegal or harmful activity
- Use the Services to violate any law, court order, regulation, or third-party right.
- Engage in fraud, deception, money laundering, sanctions evasion, market manipulation, insider trading, tax evasion, or unfair business practices.
- Harass, threaten, defame, dox, stalk, or harm any person or group.
- Generate, transmit, or facilitate child sexual abuse material; non-consensual intimate imagery; content sexualizing minors; content that incites violence, terrorism, or self-harm; or content that targets a person or protected group with hateful conduct.
- Develop, deploy, or operate weapons systems, malware, ransomware, surveillance products that violate applicable law, or unlawful biometric identification systems.
- Generate deceptive synthetic media (deepfakes) of real persons without their consent or for purposes that violate applicable law.
Data misuse
- Submit, route, or process Restricted Data — special-category personal data, biometric or genetic data used for identification, children's personal data, payment-card numbers (PAN), financial-account credentials, full government-issued identifiers, health or medical records, or criminal-offense data — without Lyberty Written Authorization in a signed addendum, order form, business associate agreement, DPA exhibit, or other executed agreement.
- Process personal data without a lawful basis, required notices, consents, opt-outs, or platform permissions.
- Use the Services to combine data sources in violation of applicable privacy laws or platform terms.
Lyberty may use automated and manual controls designed to detect, block, quarantine, or remove Restricted Data, but Lyberty does not guarantee detection of all Restricted Data. If you become aware that Restricted Data has been submitted without Lyberty Written Authorization, you must promptly notify Lyberty, stop further submission, and cooperate in remediation, deletion, isolation, and required notices.
Regulated and high-risk uses
- Use the Services as the sole basis for decisions producing legal or similarly significant effects on individuals.
- Use the Services for "high-risk" AI activities regulated under the EU AI Act, the Colorado AI Act, NYC Local Law 144, FCRA, ECOA, FHA, ADA, FERPA, HIPAA, or comparable laws — including hiring, performance evaluation, dismissal, credit, insurance, housing, education admissions or grading, healthcare diagnosis or triage, legal services, criminal-justice decisioning, biometric identification, or essential public services — unless Lyberty has expressly authorized that use in a signed addendum and the required impact assessments, notices, opt-outs, human oversight, accuracy testing, and bias testing are in place.
You must disclose proposed high-risk AI use cases to Lyberty in writing before use, complete any required use-case questionnaire or risk assessment, and promptly notify Lyberty of any actual or suspected AI incident, complaint, regulatory inquiry, safety issue, discriminatory outcome, or material malfunction relating to your use of the Services in an AI workflow.
Security and abuse
- Probe, scan, attack, denial-of-service, overload, flood, or otherwise disrupt the Services, our infrastructure, or our subprocessors.
- Attempt to bypass security, authentication, rate limits, billing, access controls, consent controls, watermarks, content filters, prompt-injection safeguards, or usage restrictions.
- Disable, block, alter, manipulate, obscure, or circumvent any usage, revenue, conversion, attribution, metering, billing, entitlement, or tracking mechanism used to operate, secure, measure, or bill for the Services.
- Send unsolicited bulk email, SMS, or messaging in violation of CAN-SPAM, CASL, ePrivacy/PECR, TCPA, or comparable laws.
- Generate, distribute, or facilitate phishing, fraud, malware, spyware, ransomware, or credential-stuffing operations.
- Use the Services to scrape, crawl, or harvest third-party properties in violation of those properties' terms or applicable law.
- Use the Services to evade or interfere with another platform's safety, anti-abuse, or anti-bot systems.
IP and reverse engineering
- Decompile, disassemble, reverse engineer, or attempt to derive source code, algorithms, model weights, fine-tunes, prompts, or trade secrets of the Services, except to the limited extent expressly permitted by mandatory law.
- Scrape, copy, mirror, or republish non-public Lyberty materials, prompts, benchmarks, telemetry, or documentation.
- Use the Services to develop, train, or improve a competing product, service, or model using non-public Lyberty materials.
Misrepresentation
- Use AI outputs to mislead users about whether content is AI-generated where disclosure is required by law (including the EU AI Act, California AB 2013/SB 942, the FTC AI guidance, or equivalent obligations).
- Misrepresent the source, authorship, or authenticity of outputs.
- Impersonate any person or entity, or falsely state or imply affiliation with, sponsorship by, or endorsement from another.
Children
- Use the Services to collect, profile, or process data of children, to deploy Lyberty technologies on websites, applications, or services directed at children, or to process children's personal data where you have actual knowledge that children are involved, unless a signed addendum expressly authorizes that use and the required parental notices, consents, COPPA/GDPR-K safeguards, and lawful bases are in place.
Customer responsibility
You are responsible for the acts and omissions of your users, employees, contractors, agents, and end users. You must implement appropriate access controls, training, monitoring, and incident response within your own organization to ensure compliance with this AUP.
Reporting abuse
If you believe a Lyberty workspace, output, or integration is being used in violation of this AUP, please report it to abuse@lyberty.ai. We treat reports confidentially and may notify the customer involved as part of our investigation.
Enforcement
Violation of this AUP is a material breach of the Terms. Lyberty may, with or without notice and at its sole discretion: investigate, remove or restrict offending content or configurations, suspend or terminate the offending workspace or account, withhold or terminate Beta Feature access, report violations to law enforcement or affected third parties, and take any other action permitted by the Terms or law. For severe violations affecting safety, security, or third-party rights, suspension may be immediate and without notice.
